Healthy Steps Nutrition App Subscription Terms & Privacy Notice

Welcome to the Healthy Steps Nutrition App (the “App”), operated by Healthy Steps Nutrition Technology, LLC (“Healthy Steps Nutrition,” “HSN,” “we,” “our,” or “us”). These Ambassador Referral Subscription Terms & Privacy Notice (the “Terms”) govern your access to and use of the App, website, and related services (collectively, the “Services”) when you enroll through a referral link provided by a gym, business, healthcare organization, coach, or other HSN Ambassador or partner (the “Referring Business”).
By creating an account, starting a trial, purchasing a subscription, or using the Services through a Referring Business’s link, you agree to these Terms, including the subscription terms and the data-sharing authorization described below.
Eligibility
You must be at least 18 years old to use the Services. By creating an account or using the Services, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and will comply with applicable laws and regulations.
What Your HSN App Subscription Includes
Your paid subscription provides access to the Healthy Steps Nutrition digital platform and the features made available for your subscription. These may include:
- Nutrition, health, and wellness education developed by Healthy Steps Nutrition;
- Nutrition and habit tracking, including meal logging and progress tracking;
- Meal photo recognition, barcode scanning, and manual food logging;
- AI-generated educational feedback related to meals and health habits;
- Healthy recipes, meal planning, and grocery list tools;
- Tracking for habits such as movement, sleep, hydration, nutrition, and mindset;
- Challenges and community features;
- Integration with supported wearable devices and health platforms; and
- Other App features HSN may add or make available from time to time.
Unless expressly included in a separate agreement or offer, your HSN App subscription does not include individualized medical care, medical nutrition therapy, diagnosis or treatment, or one-on-one nutrition or health coaching from the Referring Business or an HSN Registered Dietitian or coach.
Features may change, improve, or be removed as the platform evolves.
Free Trial, Pricing & Automatic Renewal
When you enroll through an eligible Ambassador referral link, you may receive a free trial for the period shown to you at enrollment.
You will not be charged for the subscription during your free trial. Unless you cancel before your trial ends, your subscription will automatically begin and the payment method provided at enrollment will be charged according to the subscription option you selected:
- Monthly Plan: $34.99 per month, automatically renewing each month until canceled; or
- Annual Plan: $349 per year, automatically renewing each year until canceled.
Applicable taxes, if any, may be added to the subscription price.
By starting a trial and providing a payment method, you expressly authorize HSN and its payment processor to automatically charge your selected subscription price when your trial ends and at each renewal until you cancel.
If HSN changes the price of a renewing subscription, we will provide any advance notice required by applicable law before the new price takes effect.
Cancellation & Refunds
You may cancel your subscription at any time using the cancellation method available in your account or through the billing platform used for your purchase. To avoid the first subscription charge, you must cancel before your free trial ends. To avoid a renewal charge, you must cancel before your next renewal date. This is done in the profile application settings under Manage Subscription.
Cancellation stops future renewals and takes effect at the end of the applicable trial or paid billing period. Unless otherwise required by applicable law, amounts already charged are non-refundable and we do not provide prorated refunds for unused portions of a billing period.
Sharing Information With Your Referring Business
Because you are enrolling through a Referring Business’s HSN Ambassador link, your account will be associated with that Referring Business. By enrolling through the referral link and accepting these Terms, you expressly authorize Healthy Steps Nutrition to make certain information from your HSN App account visible to and share it with the Referring Business for the purpose of supporting your engagement, accountability, and wellness experience.
Depending on the App features you use and the permissions enabled for the Referring Business, information available to the Referring Business may include:
- Your name, email address, and basic account/profile information;
- Your subscription or enrollment status;
- Goals, targets, and progress information you enter in the App;
- Meal logs, food entries, meal photos, and nutrition information;
- Habit-tracking information, such as movement, sleep, hydration, and other wellness habits;
- Health or activity information you choose to connect or enter, including information from supported wearable devices or health platforms;
- Challenge participation, community activity, and other engagement information; and
- Information or messages you intentionally share with the Referring Business through features designed for communication, feedback, community, or coaching support.
This information may reveal details about your nutrition, activity, habits, wellness, and health-related goals. You understand and agree that the Referring Business is a separate organization from Healthy Steps Nutrition.
HSN does not share your full payment-card details, account password, or text-message/SMS opt-in consent with the Referring Business. Referral-account information is not provided to the Referring Business for unrelated third-party marketing by HSN.
The Referring Business is responsible for its own handling of information it receives through its HSN business tools. You should contact the Referring Business directly if you have questions about its privacy practices.
If you no longer want your account associated with or visible to the Referring Business, contact app@healthystepsnutrition.com to ask about available disconnection options. Disconnecting from the Referring Business does not, by itself, cancel your paid HSN subscription. Subscription cancellation must be completed separately as described in Section 4.
Information We Collect
When you use the Services, HSN may collect information including:
- Account and contact information: such as your name, email address, phone number, and account credentials;
- Profile and wellness information: such as goals, targets, preferences, health and wellness information you choose to provide, and progress information;
- Nutrition and meal information: including foods, nutrition data, meal logs, meal photos, recipes, and related entries;
- Habit and activity information: including information related to movement, exercise, sleep, hydration, mindset, and other habits you track;
- Connected-device information: information you choose to connect from supported wearable devices, health platforms, or third-party integrations;
- User Content: such as messages, comments, community posts, recipes, images, or other material you submit;
- Subscription and transaction information: such as your plan, billing status, transaction history, and payment-related information provided by our payment processor. HSN may not receive or store your complete payment-card number; and
- Usage and device information: such as IP address, device type, operating system, browser or App activity, identifiers, diagnostic information, and information about how you use the Services.
How We Use Information
HSN may use information we collect to:
- Provide, operate, personalize, maintain, and improve the Services;
- Create and manage your account and subscription;
- Process payments and administer trials and renewals;
- Provide nutrition, habit, meal-planning, community, challenge, and other App features;
- Generate AI-supported educational feedback and App insights;
- Connect your account to your Referring Business as authorized in Section 5;
- Communicate with you about your account, subscription, features, security, support requests, and service updates;
- Analyze usage, troubleshoot problems, protect the security and integrity of the Services, and prevent fraud or misuse;
- Improve HSN products, services, educational content, and user experience;
- Comply with law and enforce our agreements; and
- Send marketing communications where permitted by law and your communication preferences.
Data Retention, Security & Transfers
HSN retains Personal Data for as long as reasonably necessary to provide the Services, fulfill the purposes described in these Terms, comply with legal obligations, resolve disputes, and enforce agreements. Usage information may also be retained for security, analytics, and service-improvement purposes as permitted by law.
Information may be processed or stored in locations outside your state, province, or country, where privacy laws may differ. HSN uses reasonable administrative, technical, and organizational safeguards designed to protect information. No method of electronic transmission or storage, however, can be guaranteed to be completely secure.
Your Choices, Access & Data Deletion
You may be able to review or update certain account information through the App. You may request deletion of your account and associated Personal Data through available App settings or by contacting app@healthystepsnutrition.com. Requests will be handled in accordance with applicable law and HSN’s legal and operational retention obligations.
Deleting your account may result in loss of access to the Services. If you have an active paid subscription, follow the cancellation process in Section 4 to ensure future recurring charges are stopped.
User Content
You retain ownership of content you submit through the Services. By submitting User Content, you grant HSN a worldwide, non-exclusive, royalty-free license to use, display, reproduce, process, and distribute that content as reasonably necessary to operate and improve the Services and provide features you request.
If you submit a recipe or content intended for a community library, you acknowledge that it may be viewed, saved, formatted, and used by other users as part of that feature.
You represent that you have the rights necessary to submit the content you upload.
Health & Wellness Disclaimer
The Healthy Steps Nutrition App is intended for educational and informational purposes only. The Services do not provide medical advice, diagnosis, or treatment. Content within the App, including lessons, coaching messages, AI feedback, and educational materials, is designed to support general wellness and healthy lifestyle habits.
Consult a qualified healthcare professional before making changes to your diet, exercise routine, medication, or health practices, particularly if you have a medical condition. Never disregard professional medical advice because of information provided through the Services. If you believe you may be experiencing a medical emergency, contact a healthcare professional or emergency services immediately.
Participation in nutrition, fitness, and lifestyle programs may involve risks depending on your health circumstances. By using the Services, you acknowledge that you voluntarily participate and remain responsible for your personal health decisions.
Artificial Intelligence Features
Some App features use artificial intelligence (“AI”) to generate insights or feedback related to nutrition, meal logging, or health habits. HSN’s AI systems may use educational materials developed by the Healthy Steps Nutrition Registered Dietitian team and the HSN Coach Certification curriculum.
AI-generated responses are educational and may not always be accurate, complete, or appropriate for your individual health circumstances. AI-generated content is not medical advice and should not replace advice from a qualified healthcare professional.
Acceptable Use
You agree not to misuse the Services, including by violating applicable law; harassing or harming other users; posting unlawful, abusive, deceptive, or infringing content; attempting to disrupt, hack, reverse engineer, or gain unauthorized access to the Services; uploading malicious code; or misrepresenting your identity or credentials.
HSN may remove content or suspend or terminate accounts that violate these Terms or threaten the safety, security, or integrity of the Services.
Third-Party Services & Integrations
The Services may integrate with third-party platforms, payment processors, wearable technologies, or health data services. HSN does not control these third parties and is not responsible for their independent functionality, data accuracy, security, or privacy practices. Your use of third-party services may also be governed by their own terms and privacy policies.
Intellectual Property
Except for User Content, the Services and HSN content, including text, graphics, logos, educational materials, software, and design elements, are owned by or licensed to Healthy Steps Nutrition and protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from the Services except as permitted by law or with prior written permission.
Disclaimer of Warranties
The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, HSN disclaims warranties, express or implied, regarding the Services, including their accuracy, reliability, availability, or results.
Limitation of Liability
To the maximum extent permitted by applicable law, Healthy Steps Nutrition will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from your use of the Services. To the maximum extent permitted by law, HSN’s total liability for claims related to the Services will not exceed the amount you paid for the Services during the twelve months preceding the event giving rise to the claim.
Arbitration Agreement & Class Action Waiver
To the extent permitted by applicable law, any dispute arising out of or relating to these Terms or use of the Services will be resolved through binding arbitration rather than in court. Arbitration will be conducted in accordance with the applicable rules of the American Arbitration Association (AAA) and will take place in the State of Florida unless applicable law requires otherwise.
To the extent permitted by law, dispute-resolution proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive the right to participate in a class action or class-wide arbitration against HSN.
Changes to These Terms
HSN may update these Terms from time to time. If we make material changes, we may provide notice through the App, by email, or by another method required by applicable law. The “Last Updated” date will identify the most recent version.
Changes will apply prospectively as required by applicable law. Your continued use of the Services after updated Terms take effect constitutes acceptance where permitted by law.
Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
